Do I need it?

  • With limited exceptions, every employer in the Commonwealth with one or more employee(s) is required by law to have a valid workers’ compensation policy at all times.
  • You are required to carry workers’ compensation insurance in Massachusetts if:
  • You have any employees working in Massachusetts, including family members and yourself if you are considered an employee.
  • You’re going to work for someone else. If you do work for a general contractor they may want you purchase a policy in order to work on a particular job they are overseeing.

Certificates of insurance

If you are a sole proprietor working for general contractor, they will need to see a certificate of insurance from you, otherwise they will need to cover you themselves and most likely charge you or deduct a portion of your payment to pay for that coverage.
